These Terms of Service ("Terms") govern your use of LipSurf ("the Service") provided by LipSurf, Inc. ("the Company"). By using the Service, you agree to be bound by these Terms.

Refunds and Cancellations

LipSurf, Inc. offers a 5-day grace period for refunds and cancellations for all purchases made through the Service. If you are not satisfied with the Service for any reason, you may request a refund or cancellation within 5 days of your payment. Requests for refunds or cancellations after the 5-day grace period will not be honored.

To request a refund or cancellation, please contact LipSurf, Inc.'s customer support team. LipSurf, Inc. reserves the right to refuse any refund or cancellation request that it deems to be fraudulent or in violation of these Terms.

Intellectual Property

All content and materials available through the Service, including but not limited to text, graphics, logos, images, and software, are the property of LipSurf, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any content or materials available through the Service for any commercial or public purpose without the prior written permission of LipSurf, Inc.

THE SERVICE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. LIPSURF, INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIPSURF, INC. DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

LIPSURF, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA. LIPSURF, INC.'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICE.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California without giving effect to any principles of conflicts of law. You agree that any dispute arising out of or related to these Terms shall be brought exclusively in the courts located in San Francisco County, California and you hereby consent to the jurisdiction of such courts.

Changes to the Terms

LipSurf, Inc. reserves the right to modify these Terms at any time, without prior notice. Your continued use of the Service after any such modifications constitutes your acceptance of the new Terms.

Miscellaneous

These Terms constitute the entire agreement between you and LipSurf, Inc. and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and LipSurf, Inc. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The failure of LipSurf, Inc. to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
